RETURNS AND WITHDRAWALS

Pursuant to European Directive 2011/83, implemented in Italy by Legislative Decree no. 21 of 21/02/2014, customers/consumers are entitled to withdraw from the purchase contract for any reason, with no need to provide explanations.

1. RIGHT TO WITHDRAWAL

  • You may exercise your withdrawal right within 14 days of receipt of the goods. You must notify us of your intention to exercise this right at info@rubinetteria.com. After this deadline, your request can no longer be accepted.
  • Only the customer/consumer, meaning a natural person who has purchased the goods for purposes unrelated to their business, and who has therefore not included a VAT registration number in the order form, is entitled to exercise this right.

2. EXCLUSION OF THE RIGHT OF WITHDRAWAL 

  • The right of withdrawal of the non-consumer customer, that is, somebody who makes a purchase with a VAT number, is excluded with regard to Rubinetteria in accordance with Art. 131 of Italian Legislative Decree 206/2005 ("Consumer Code").
  • You may not exercise the withdrawal right unless you are able to return the original packaging, everything supplied with the product and everything contained in the original pack.
  • You may not exercise the withdrawal right with regard to only part of the product purchased.
  • You may not exercise the right of withdrawal on:
    • Products already installed.
    • Assembled, used, soiled products.
    • Supply of made-to-measure and/or customised goods.
    • Supply of goods which may deteriorate or expire quickly.
    • Supply of sealed goods which cannot be returned due to reasons of hygiene or reasons relating to health protection, and which have been opened after delivery.
    • Supply of products which have been inseparably mixed with other goods after delivery,

3. WITHDRAWAL PROCEDURE

Within 14 days of the delivery date, you must send a registered letter with return receipt to ACQUATICA Via Rodi 1 c/d – 25033 COLOGNE (BS), or an email to info@rubinetteria.com or a certified email to acquatica.amministrazione@pec.it. The declaration must include your full details (name, surname, contacts such as telephone and/or fax number and/or email address, invoice address, delivery address if different from the invoice address, the order date and number, code and description of the product(s) for which you intend to exercise the right of withdrawal, date of receipt of the products, the invoice date and number and your signature.

You may use the withdrawal form (Italian Legislative Decree 21/ 2014 – provisions of Art. 1, sub-section 1- “ANNEX 1” -part B  – pursuant to Art. 49, sub-section 4).

  1. Once it receives the withdrawal notification, the Rubinetteria.com Customer Care Service will provide you without delay with instructions for the return of the goods.
  2. You must pack the goods carefully to avoid damage during shipment. You must use the original packaging and the product must be complete with everything it originally contained. Products must NOT have been assembled, installed, used or dirtied and must NOT be damaged and/or modified. We advise you to use an insured courier.
  3. You will be required to meet the shipping costs and will be liable for the product during shipment. In the event of loss, theft or any other mishap, Rubinetteria.com reserves the right to charge you for any damage incurred.
  4. The customer must send the product by courier within 14 days of consent to the return by Rubinetteria.com.

After receiving the product(s), Rubinetteria.com will check the product(s) for damage and to ensure that all the original accessories have been returned. It will also check that all the requirements for correct exercise of the right of withdrawal have been complied with and will notify you by email of the outcome of this check.

4. REFUND TIMES AND PROCEDURES

The vendor will refund you all the payments received except for the delivery costs and any packaging costs or other additional costs specified at the time of order, and the administrative costs of handling the return. If you have benefited from discounts and/or special or promotional offers conditional on the reaching of a specific purchase value (e.g. free shipment for orders over X euros) and/or purchase of a specific number and/or combination of products (e.g. 10% discount on product A if purchased together with product B) and the conditions for applicability of the discounts and/or special and/or promotional offers are no longer met after exercise of the withdrawal right, Rubinetteria.com will recalculate the total value of your purchase including only the goods you have purchased and retained, not considering these special reductions, and will then charge you the increased amount due, which will be deducted when the refund is calculated.

You have sole responsibility for any reduction in the value of the goods due to any handling of them that has taken place (over and above what is necessary to establish their type, characteristics and operation).

In order to establish the type, characteristics and operation of the products, you should only handle and inspect them in exactly the same way as would be permitted in a shop. Therefore, during the period of grace for withdrawal you should handle and inspect the goods with due care.

If the product is damaged in transit, Rubinetteria.com will notify you of what has occurred (within five working days of receipt of the product at its warehouse), to enable you to immediately lodge a claim with your chosen courier and obtain a refund of the value of the product (if insured by the customer).

Whatever payment method you have used, Rubinetteria.com will refund you in the shortest possible time, and in all cases within fourteen days of the date when it became aware of your intention to exercise the withdrawal right, further to verification that the right has been exercised properly and inspection of the products returned. Rubinetteria will refund you using the payment method you used for the initial transaction, unless you have specifically agreed a different payment method and provided you do not face any additional charges as a consequence of the refund. The actual time required for accreditation or return of the sums due further to exercise of the withdrawal right depends on the payment method used for the purchase.

In the event of a refund by bank transfer, you are obliged to provide Rubinetteria.com with your bank details (IBAN, SWIFT and BIC codes).

The time required for the refund will depend on how quickly you provide the correct data; it will normally take up to 14 days.

If the customer who purchased the goods and made the payment is not the recipient of the goods, the relative amount will still be refunded to the person who made the payment.

5. COMPLAINTS

Any complaints concerning delivery of the products and their characteristics on delivery must be reported on Rubinetteria.com by email to info@rubinetteria.com.

You must lodge a complaint about any external damage or missing packs with the courier at once and also report it on Rubinetteria.com by email atinfo@rubinetteria.com within 5 days of delivery.

Any non-apparent damage discovered after delivery of the products, attaching clear pictures of the damage, must be reported on Rubinetteria.com within 5 days of their discovery by email to info@rubinetteria.com. No disputes will be accepted after this time.

BEFORE ACCEPTING THE GOODS

  • Check the packaging for damage, and the number of packs, in the courier's presence.
  • If the packaging is damaged (bent, torn, dented, etc.) sign with specific reservation subject to inspection of the goods, stating the type of damage on the courier's delivery note (e.g. "accepted under reservation due to torn packaging, ..).
  • If the courier does not allow you to enter your reservation, refuse delivery of the goods.
  • If, despite the packaging being intact, the material inside is damaged, report the damage within 5 days of receiving the product by email to info@rubinetteria.com describing what happened and attaching photographs of both the damaged item and the packaging. No disputes will be accepted after the 5-day period.
